Municipal Committee

The establishment, the matters concerning the tasks and the authorities of the Municipal Committee, which is one of the bodies of Municipal Organization, is regulated by article 33 and 34 of the Law of Municipal Offices number 5272, which was adopted on 7 December 2004 and came into effect by being issued in the Official Journal number 25680 on the date 24 December 2004.

The Municipal Committee consists of, under the chairmanship of the Mayor;
a) four members to be elected by secret vote by the municipal council among its own members for 1 year and four members, as one of the four is the chief of financial services unit, to be selected by the mayor among the chiefs of units every year, for provincial municipal offices and the municipal offices the populations of which are more than 100.000,
b) three members to be elected by secret vote by the municipal council among its own members for one year and three members, as one of the three is the chief of financial services unit, to be selected by the mayor among the chiefs of units every year, for other municipal offices.

In meetings that the mayor does not attend, the vice mayor to be assigned by the mayor or a committee member chairs the committee.

In the municipal committee meetings, the concerned unit chiefs may be invited for their opinions to be taken about the agenda issues by the mayor without right to vote.

The tasks and the authorities of the committee are as follows:
 a) To examine the strategic plan and the annual work plan and the final accounts, and to report opinions to the municipal council.
b) To make and to implement the decisions of confiscation about the works included in the annual work program.
c) To determine the expenditure items of the allocation of unforeseeable expenditures.
d) To do transfers among the secondary levels of the functional classification in the budget.
e) To impose the penalties anticipated in the legislations.
f) To decide for the discharge by agreement of the municipal receivables subject to litigation, which are out of taxes, duties and fees and the amount of which exceed five billion Turkish Liras.
g) To implement the council decisions concerning sales, exchange and allocation of immovables, to decide for those to be rented as the term not to exceed three years.
h) To determine the opening and closing times for public places.
ı) To perform the task imposed to municipal committee in other legislations.

According to article 35 of the Law number 5272,
The municipal committee gathers on the pre-determined day at the pre-determined time as not to be less than one a week. The mayor may call the committee for meeting in emergency. The committee gathers with the absolute majority of the full member number and decisions are taken by the absolute majority of the attending. In case of equality of votes, the side where the mayor stands is considered as the majority. No non-committal votes are permitted.
The agenda of committee is prepared by the mayor. Members of the committee may propose agenda articles by the mayor's positive opinion. The matters not relegated by the mayor may not be discussed in the committee.
The matters relegated to the committee are discussed and decided about within one week.
The decisions taken are signed by the chairman and the attending members. Those who oppose the decision explain their justifications.
The chairman and the members of the committee, exclusively, may not attend the committee meetings where affairs about themselves, their second degree blood relatives and relatives in law and their adoptive children are discussed.
